Terms and conditions
These terms and conditions, as may be amended from time to time, apply to all our services directly or indirectly (through distributors) made available online, through any mobile device, by email or by telephone. By accessing, browsing and using our (mobile) website and/or by completing a reservation, you acknowledge and agree to have read, understood and agreed to the terms and conditions set out below.
“Accommodation”, “Villa”, “us”, “we” or “our” means Villa Arun Bali, but on/at the “Location” also means the Sumberkima Hill Retreat.
“Location” means Sumberkima Hill Retreat, Gerokgak 81155, Buleleng Regency, Bali, Indonesia.
All prices are per Villa entity for your entire stay and including accommodation service charges and the Indonesian VAT (11% as from April 1st, 2022).
The prices are offered in Euro, apply to direct booking through this website and may appear unusual after conversion to your local currency. These prices may not appear to be the lowest prices to you as indirect booking always subject to charges and fees, immediately visible or of which later calculated in the end price. We do not claim to offer the lowest price possible and are not obliged, but entitled, to grant you lower prices during reservation process.
The Villa prices include the use of a furnished and fully-equipped Villa for the duration of the stay, household linen, crockery, cutlery and electrical household appliances, the cost of water, electricity, pool maintenance, garden maintenance and the Accommodation’s staff for transfer of keys and other formalities.
The prices Do Not include the cost of telephone calls with exception phone calls made using the provided telephone for assistance of inquiries from our staff. Also not included are any optional services not previously specified and billed, client’s travel insurance, medical insurance or personal liability insurance.
Breakfast is Optional (for extra charges).
2. Credit card or bank transfer
We offer the opportunity for reservations to be paid (wholly or partly and as required under the payment policy of the accommodation) during the reservation process by means of secure online payment (all to the extent offered and supported by your bank) through international bank transfer, Wise, or PayPal (credit card). You will receive an invoice and/or a payment receipt.
3. Reservation, cancellation, no-show
By making a reservation with us, you accept and agree to our relevant cancellation and no-show policy.
To reserve a Villa, you are due to pay an initial deposit (25% of the total rent due). The deposit is non refundable for cancellation less than 3 months prior to arrival date. Please check the (reservation) details thoroughly prior to making your booking. The reservation is not effective until required payment is received. Reservations can only be accepted if you are 18 or older at the time of the reservation.
The balance of the rent is payable 30 days before arrival, directly to us, unless otherwise specified. If full payment is not received as specified, we reserve the right to cancel the booking and refuse your admission to the Villa. Late payment, wrong bank, debit or credit card details, invalid credit/debit cards or insufficient funds are for your own risk and account and you shall not be entitled to any refund of any (non-refundable) prepaid amount unless we agree or allow otherwise under the (pre)payment and cancellation policy.
If you wish to review, adjust or cancel your reservation, please revert to the confirmation email. For cancellation of the booking of the villa or in the event of a no-show, please note that you shall not be entitled to any refund of any (non-refundable) prepaid amount. Applicable taxes may also still be charged in the event of a no-show or charged cancellation.
If you have a late or delayed arrival on the check-in date or only arrive the next day, make sure to (timely/promptly) communicate this with us or the staff at the location so they know when to expect you, to avoid cancellation of your reservation or room or charge of the no-show fee.
In the event of a no-show, we are entitled to offer the Villa again for reservation.
4. Conditions of Stay
The rental period shall commence 2.00 pm on the first day and end at 11.00 am on the last day of the rental period, unless otherwise agreed or specified. We shall not be obliged to offer accommodation before the time stated and you shall not be entitled to remain in occupation after the time stated.
The maximum number of people residing in the Villa cannot exceed the number stated on the on the Villa specifications without our explicit permission. We reserve the right to refuse service or rentals to anyone at their complete discretion.
Accommodation is provided for the sole purpose of tourism. You are responsible for and must exercise care in securing all personal property.
When you stay at our villa, you shall treat the property of the villa with respect. It is forbidden to fix objects to the walls and to displace furniture and appliances. You shall not be the source of excessive noise or other disruption, and respect Accommodation’s and Location’s regulations concerning the use of the communal areas.
5. Overstaying without the Accommodation’s Consent
If you stay past the agreed upon checkout time without our consent, you no longer have a license to stay in the Villa and we are entitled to make you leave or charge the extra 24 hour period of the overstay, and may include an extra charge to cover the inconvenience suffered by the Accommodation, plus all applicable service fees, taxes, and any legal expenses incurred by the Accommodation to make you leave the Villa.
Any violation of the above Terms and Conditions will lead to immediate termination of the rental 24 hours following a formal notice to cease such violation. Failing to comply will require you to vacate the Villa, Accommodation or Location immediately and without any compensation.
In the event of overbooking, we are due to offer you a comparable alternative Accommodation, without extra charges.
Subject to the limitations set out in these terms and conditions and to the extent permitted by law, we shall only be liable for direct damages actually suffered, paid or incurred by you due to an attributable shortcoming of our obligations in respect to our services, up to an aggregate amount of the aggregate cost of your reservation as set out in the confirmation email (whether for one event or series of connected events).
To the extent permitted by law, these terms and conditions and the provision of our services shall be governed by and construed in accordance with Dutch law and any dispute arising out of these general terms and conditions and our services shall exclusively be submitted to the competent courts in Amsterdam, the Netherlands.
The original English version of these terms and conditions may have been translated into other languages. The translated version is a courtesy and office translation only and you cannot derive any rights from the translated version. In the event of a dispute about the contents or interpretation of these terms and conditions or inconsistency or discrepancy between the English version and any other language version of these terms and conditions, the English language version to the extent permitted by law shall apply, prevail and be conclusive.
